1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the Smartcare platform, offered by Smartcare Analytica AB (Sweden) and its subsidiaries (“Smartcare”, “we”, “our”, “us”). By creating an account or using Smartcare services, you (“you”, “your”, “Clinic”, “Doctor”) agree to be bound by these Terms. If you do not agree, you must not use Smartcare.

2. Services Provided

Smartcare is a software-as-a-service (SaaS) platform designed for doctors and clinics to manage appointments, consultations, electronic medical records, billing, and related workflows.

Smartcare does not provide medical advice, diagnosis, or treatment. All clinical decisions remain the sole responsibility of the practitioner/clinic.

3. Eligibility

You must be at least 18 years old and legally authorized to practice or operate a healthcare facility in your jurisdiction. By registering, you represent that the information you provide is true, accurate, and complete.

4. Subscription & Payments

  • Use of Smartcare requires a valid subscription plan. Pricing may vary by specialty, geography, or plan type.
  • Subscriptions are billed in advance, on an annual or monthly basis, as agreed.
  • Fees are non-refundable, except where required by law.
  • Smartcare reserves the right to suspend access in case of non-payment.

5. Acceptable Use

You agree to:

  1. Use Smartcare only for lawful purposes.
  2. Comply with all applicable healthcare, data protection, and privacy laws.
  3. Not misuse, copy, or reverse engineer Smartcare’s software.
  4. Not upload harmful code or unauthorized patient data.

6. Data Responsibility

Clinics/doctors remain responsible for the accuracy, legality, and validity of patient data they input into Smartcare. Smartcare acts as a data processor (under GDPR) or service provider (under Indian IT/SPDI Rules), hosting and securing data on your behalf.

7. Intellectual Property

Smartcare owns all rights in the platform, including design, code, and features. You receive a limited, non-exclusive, non-transferable license to use Smartcare during your active subscription.

8. Limitation of Liability

Smartcare is provided “as is” and “as available”. To the maximum extent permitted by law, Smartcare is not liable for medical outcomes, lost profits, indirect damages, or data loss. Our total liability for any claim is limited to the amount you paid to Smartcare in the 12 months preceding the claim.

9. Termination

You may stop using Smartcare at any time. Smartcare may suspend or terminate accounts in case of breach, misuse, or unpaid fees. Upon termination, your access will be revoked. We may retain certain records as required by law.

10. Governing Law & Disputes

For customers in India: governed by Indian law; disputes subject to courts of Noida, Uttar Pradesh. For customers in Europe/elsewhere: governed by Swedish law; disputes subject to courts of Malmö, Sweden.
